Advocacy
Advocacy is the act of the solicitor (or more typically, a barrister) putting their client's case to the court. This may happen if a case cannot be resolved via negotiation between the clients’ solicitors (e.g. a divorcing couple cannot come to an agreement on how their finances should be divided), and so the case may then have to go to court in order for a judge to enforce a solution.
CAFCASS
CAFCASS is an acronym for ‘Children and Family Court Advisory and Support Service’. It is a public body that exists to consider the best interests of the children involved in family law cases. The officers at CAFCASS offer advice to family courts on what they think is in the best interests of the children involved as a result of their enquiries into a family setting. In some cases they are asked to produce a report for the court with recommendations that include who the children should live with, and what time they should spend with the other parent.
Child Arrangements Order
A child arrangements order is a court order that defines who is responsible for the care of a child, including who they live with and how often the child will have contact the parents. This type of order can be necessary if the parents cannot agree on how to share the care of their child/ren.
Collaborative Lawyer
A collaborative lawyer is trained to represent their client through a collaborative divorce process or family dispute. The clients on both sides sign up to to the collaborative divorce process which can involve them and their lawyers attending four-way meetings in order to negotiate and reach a formal agreement that avoids the need for any court hearings.
Consultant Solicitor/Lawyer
A consultant solicitor provides services on a self-employed basis or as a contractor, but typically does so under the umbrella of a law firm. The client will be represented by a consultant solicitor in the same way as they would if the solicitor was an employee of the firm, but once the client pays the firm for the consultant solicitor’s services, the firm will typically pay the consultant solicitor’s business (e.g. a Limited Company) a percentage of those fees, rather than pay a salary. In most cases, the differences between a salaried solicitor and a consultant solicitor relate to how the consultant solicitor is employed and paid. There is little to no noticeable difference for the client.
Prohibited Steps Order
A prohibited steps order is a court order usually applies to a parent and prevents them from conducting certain activities with their child/ren who are under 16 years old (such as preventing the parent from removing the child from school, or them taking the child abroad, or changing their surname). It also prevents the parent from exercising their parental responsibility.
Resolution
Resolution is an industry body with a membership made up primarily of family lawyers. As members, the lawyers agree to conduct their work in line with Resolution’s Code of Conduct which is based on taking a “non-confrontational approach to family law issues”. This means that the lawyer actively tries to reduce conflict between the parties and encourages families to put the best interests of any children first.
Specific Issue Order
A Specific Issue Order is a court order that sets out how a specific question or issue regarding a child should be addressed by the parents. This could be a specific issue that the parents cannot agree on, such as which school the child should attend, or if certain medical treatment should or shouldn’t be administered. If the parents cannot agree, the court can enforce an answer via a Specific Issue Order.
TOLATA (Trusts of Land and Appointment of Trustees Act)
TOLATA relates to disputes between two individuals who have lived together and now disagree on a matter relating to their cohabitation. Most commonly, this relates to disputes over who owns the property, what the split of ownership is, or who should remain in the property.
The Legal 500
The Legal 500 is a directory of solicitors and firms, broken down by geographic region and legal discipline. Solicitors are ranked in The Legal 500 based on their merit and experience, using publicly available information and information supplied by the firm. Annually, The Legal 500 issues awards to individual law firms and solicitors such as ‘Leading Individual’, ‘Recommended Lawyer’, ‘Rising Star’ and ‘Leading Firm’. It is worth noting that the ‘500’ in the name does not refer to the number of firms/solicitors that are ranked, which is actually a significantly larger number. Nonetheless, it is still a highly regarded award in the legal profession.
